Welcome to Draco Collective. These Terms of Service (“Terms”) govern your access to and use of the website dracocollective.world (the “Site”) and any purchases you make through it. By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.

Draco Collective is a clothing and lifestyle brand designed in Wales, UK.

2. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to place an order. By using the Site you confirm that you meet this requirement.

3. Products & Availability
- All products are made to order.
- We reserve the right to limit quantities, discontinue products, or refuse any order at our discretion.
- Product images are for illustrative purposes. Slight variations in colour, fit, or finish may occur due to manufacturing processes and screen display differences.
- We aim to display accurate product information, but we do not warrant that descriptions, pricing, or other content is error-free.

4. Orders & Acceptance
- Placing an order constitutes an offer to purchase.
- We will confirm receipt of your order by email. This confirmation does not mean the order has been accepted.
- Acceptance occurs when we begin production or dispatch the goods.
- We reserve the right to cancel any order (and issue a full refund) if we are unable to fulfil it for any reason, including stock, pricing, or technical errors.

5. Pricing & Payment
- All prices are shown in the currency selected on the Site and include applicable taxes unless otherwise stated.
- Prices may change at any time without notice. The price charged will be the price displayed at the time you place your order.
- Payment must be made in full at the time of purchase via the available payment methods.
- You are responsible for any bank charges, currency conversion fees, or local taxes that may apply.

 6. Shipping & Delivery
- Delivery times are estimates only and begin once production is complete.
- Risk of loss or damage passes to you upon delivery (or upon collection if applicable).
- You are responsible for providing accurate shipping information. We are not liable for delays or non-delivery caused by incorrect addresses or other information supplied by you.
- Customs duties, import taxes, or other charges that may apply in your country are your responsibility.

7. Returns, Refunds & Cancellations
Our Returns & Refunds Policy forms part of these Terms. Please review it carefully.  
In summary:
- Returns and refund requests must be made within the timeframes stated in that policy.
- Certain items (e.g. underwear, swimwear, masks) are non-returnable for hygiene reasons unless defective.
- Orders can only be cancelled while still in the “In Review” stage.

8. Intellectual Property
All content on the Site — including logos, designs, text, graphics, images, and product artwork — is owned by or licensed to Draco Collective and is protected by copyright, trademark, and other intellectual property laws.  
You may not copy, reproduce, distribute, modify, or create derivative works from any content without our prior written permission.

9. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorised access to any part of the Site or its systems
- Upload or transmit viruses, malware, or any harmful code
- Scrape, harvest, or collect data from the Site without permission
- Interfere with the proper working of the Site

We reserve the right to suspend or terminate access for any breach of these Terms.

10. Limitation of Liability
To the fullest extent permitted by law:
- Draco Collective shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any products purchased.
- Our total liability for any claim relating to an order shall not exceed the amount you paid for that order.
- Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

You agree to indemnify and hold harmless Draco Collective, its owners, and affiliates from any claims, losses, damages, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site or products.

12. Governing Law & Disputes
These Terms are governed by the laws of England and Wales.  
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection laws in your country of residence provide otherwise.

We may update these Terms from time to time. The “Last updated” date at the top will indicate when changes were made. Continued use of the Site after changes constitutes acceptance of the revised Terms.
